Downloading and temporary caching of pages on a personal computer for the explicit purpose of viewing this website is permitted, as is any use of materials clearly marked as reproducible.
2. DMCA Provisions
The Digital Millennium Copyright Act of 1998, found at 17 U.S.C. § 512 (“DMCA”), provides recourse for owners of copyrighted materials who believe their rights under U.S. copyright law have been infringed upon on the internet.
Under the DMCA, a copyright owner who has a good faith belief that their copyright has been infringed may contact:
- The person or entity allegedly infringing their copyright, and/or
- The designated agent of an internet service provider (“ISP”) to report alleged infringements of protected works appearing on or through the ISP’s system or network.
The Website Owner and any associated ISP are committed to compliance with all relevant laws. Upon receipt of a properly filed complaint under the DMCA:
- Access to the allegedly infringing material may be blocked.
- A copy of the notification may be forwarded to the alleged infringer.
- Anyone who believes in good faith that a notice of copyright infringement has been wrongfully filed against them may submit a counter-notification to the Website Owner and/or the ISP.
3. Notification of Claimed Copyright Infringement
If you believe your copyright has been infringed, you must submit a notification that includes the following information (17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple copyrighted works are covered by a single notification.
- Identification of the allegedly infringing material (including the specific URLs) and a description of where the infringing work is located on the website. Be as specific as possible.
- Information reasonably sufficient to permit the Website Owner to contact you, including an email address and phone number.
- The following statement (or one with equivalent meaning):
“I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. I also affirm that as the copyright owner, I have a good faith belief that use of the material in the manner complained of is not authorized by me, my agent, or the law.”
- A signature (physical or electronic) of the copyright owner or a person authorized to act on the copyright owner’s behalf.
Warning: You may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that content on the website is infringing your copyright.
